Terms and Conditions: Healthy Heroes

At B Fitness Asia Sdn. Bhd. (1204067-X), its subsidiaries and affiliates including operating under the Babel brand (collectively known as “Babel”), we have adopted policies, procedures, rules and regulations, terms and conditions ("policies") designed to provide for the safe, enjoyable and healthy use of our premises and events for our members and trial member, guest, purchaser or user (collectively known as "guest"). These policies apply to your conduct in Babel's premises, which include its centres and all outdoor areas, including its swimming pool, parking lots, sidewalks (collectively known as "premises"). They also apply to your conduct during its programmes, training, workshops, events or other activities off the premises involving Babel (collectively known as "events").

 

The following terms & conditions govern the rights and obligation of Babel and members thereof:

PRIVACY POLICY

  1. Babel respects your privacy and uses your personal information in an effort to offer our members the perfect wellness experience. The Privacy Policy describes the privacy practices of Babel, including the types of personal information we collect from our members and guests and from other users of our website, official social media platforms and the downloadable Babel-branded mobile application (collectively known as “Babel App”), how we use this personal information and with whom we share it, in accordance with the Personal Data Protection Act 2010. By using or interacting with the Babel App, you are acknowledging that you have read, understand and agreed to and expressly consent to our collection, use and disclosure of your personal information, as described in the Privacy Policy.
     

  2. By agreeing to participate in the selection for the Healthy Heroes Program; you hereby agree that all data and photos provided for submission are for Babel’s internal use and participation selection only. Photos provided will not be shared with any third parties.
     

  3. All personal information provided by you will be deemed to be accurate and complete, and Babel reserves the right for the final decision of the selection process.

GENERAL

PERSONAL
FITNESS DECLARATION

       
 

  1. Before engaging in any of our fitness activities, we strongly advise that you obtain a medical clearance from a Doctor if you have any doubts about your physical capability to engage in any exercise.

  2. You are to abide with Babel's rules and instructions including warning notices when using our equipment and facilities. If you experience any illness or discomfort physically, please notify us immediately. We are not responsible for the medical requirements of our members and guests.

     

LIMITATION
OF LIABILITY

  1. By attending classes, events, activities, using training facilities and equipment, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers whilst exercising in Babel. You acknowledge that you have voluntarily chosen to participate in intense physical activity. You hereby agree to assume full responsibility for yourself and all injuries or damage, which are sustained or aggravated by you in relation to the use of equipment and/or our training facilities, and release, indemnify, and hold harmless of Babel.
     

  2. Babel accepts no responsibility for loss or damage on members' or their guests' properties or for death or injuries sustained while on the premises. Members and their guests agree that no claims will be made against Babel, the Management or staff for any reason whatsoever.
     

  3. Babel, its associated companies, employees or agents shall not be responsible for any claims, demands, injuries, damages or actions for negligence arising on account of death or due to injury, loss, damage or theft to a member's person or property arising out of or in connection with the use by a member of any of the services, facilities on the premises of Babel. The member hereby holds Babel, its associated companies, employees and agents harmless from all claims which may be brought against them by or on a member's behalf for any such injuries or claims aforesaid. Any guest of a member or a temporary visitor to Babel shall agree to abide by Babel's rules and the same limitation of liabilities for a member shall apply. All prices and amount quoted here are subject to taxes where applicable.

MISCELLANEOUS

  1. Failure by the Management to enforce any of the their respective rights at any time for any period shall not be construed as a waiver of such rights

  2. The Management reserves the right to use any individual or group photographs of members and/or guests for press or promotional purposes.

  3. Any guests or members are not allowed to photograph or copy any club interior designs, promotional materials, tag lines or theme.

  4. All members must abide by the rules of Babel which may be amended, varied, deleted and added from time to time at the Management's discretion.

  5. Babel reserves the right to proceed with legal action to any member caught distributing, sharing or supplying such contents to any third party vendor or competitor.

  6. All participants selected to participate as a Healthy Hero will be subject to additional terms and conditions pertaining to marketing consent, program adherence and physical activity readiness questionnaire.

  7. These Rules shall be governed and construed in accordance with the laws of Malaysia and subject to the jurisdiction of Malaysia.

  8. Entry to Babel's Healthy Heroes Programme is only open for non-members
