    At B Fitness Asia Sdn. Bhd. (1204067-X), its subsidiaries and affiliates including Babel Academy operating under the Babel brand (collectively known as “Babel”), we have adopted policies, procedures, rules and regulations, terms and conditions ("policies") designed to provide for the safe, enjoyable and healthy use of our premises and events for our members and trial member, guest, purchaser or user (collectively known as "guest").

    These policies apply to your conduct in Babel's premises, which include its centres and all outdoor areas, including its swimming pool, parking lots, sidewalks (collectively known as "premises"). They also apply to your conduct during its programmes, training, workshops, events or other activities off the premises involving Babel (collectively known as "events").

     

    The following terms & conditions govern the rights and obligation of Babel and members thereof:

     

    MONTHLY | HALF YEARLY | YEARLY MEMBERSHIPS

     

    MEMBERSHIP

    1. Membership is personal to the individual signed up and is non-assignable, non-refundable and non-transferable.
    2. The Management reserves the right to reject any application for Babel's membership for any reason whatsoever.            
    3. Monthly members are required to pay an Initial Joining Fee which is the specified sum. The Joining Fee will be used to REBATE and offset the 13th month membership dues when member fulfills an active membership of 12 months consecutively.
    4. Refunds - Joining Fees and Membership Fees are NOT refundable upon termination of membership for any reason whatsoever.        
    5. Freezing - Member may email to [email protected] to freeze his/her membership at any time with a MINIMUM term of 1 month. First 3 freezing months of the calendar year (not necessarily consecutive) will be free of charge. Subsequent freezing months will be charged a minimal freezing fee of RM50.00 per month. NO BACK DATE freeze will be allowed, all freezing request MUST be emailed 7 days prior to freezing start date.    
    6. Cancellation - Member may email to [email protected] to cancel his/her membership stating the reason for cancellation. Cancellation request must be made at least  7 days prior to the next billing date. Member is required to settle all outstanding payments and return the membership card before cancellation can occur.
     

      PERSONAL TRAINING

       

      PERSONAL TRAINING SERVICES

      1. Member must complete all details for the Personal Training Services Agreement, sign it and retain a copy of it for his or her records.
      2. Member's personal training is an arrangement between him or her and the operator of the Home Club as specified in the Personal Training Agreement. Once he or she has signed a copy of the Personal Training Services Agreement, member has agreed to be bound by a binding contract.     
      3. Fitness Instructor/Trainer is not a medical professional and is without expertise to diagnose medical conditions or impairments. The member agrees to promptly and fully disclose to Fitness Instructor/Trainer any injury, condition or impairment which may have a deleterious effect on or be impacted by this training program and the Fitness Instructor's/Trainer’s decision to discontinue training because of any condition which presents an adverse risk or threat to the health or safety of the member, the Fitness Instructor/Trainer or others shall be conclusive.
      4. The fee for the program is payable in advance of Sessions in one lump sum (at least) 3 days prior to the scheduled session appointment. Payments should be made at Customer Service Counter or via the Babel App (as defined below). The member will not be allowed to pay the Fitness Instructor/Trainer directly for a session.
      5. Fitness Profile Package - As marked in Personal Training Package Section, all sessions has an ‘End Date’ or 'Expiration Date'. If in any case the purchased Personal Training Package will not be finished before the "Expiration Date", all the remaining sessions will be forfeited.
      6. The time of sessions is to be agreed upon between the trainer and the member. You must arrive on time for the scheduled appointment. If you arrive late by any chance, do understand that your session will end at the originally scheduled time.
      7. The member must give twenty-four (24) hour cancellation notice. It is required for rescheduling or cancelling any and all individual Sessions. Failure to do so will result in forfeiture of the sessions and no sessions or payment reimbursement will be granted.
      8. Any tardiness of more than 15 minutes or absence without proper notification will result in forfeiting the session and no sessions or payment reimbursement will be granted. All one on one personal training sessions will start and end no more than allocated time, as per purchased package (1 hour & 30 minutes).
      9. Shall his or her Coach cancel the session within the 24 hour notice period, he or she will be ensured of a substitute Coach for the scheduled session. If the member is not satisfied with services of the current Fitness Instructor/Trainer (provided solid reasons), we will be glad to offer him or her a different Fitness Instructor/Trainer.
      10. Refunds - All personal training package fees are non-refundable, even if the member cannot or does no participate in all of the training session in the program. There shall be no refund of any monies paid by Babel in any event whatsoever.
      11. The member is responsible to verify every session with the Fitness Instructor/Trainer by signing a Confirmation of Conducted Personal Training Sessions form (COC).
      12. Babel reserves the right to assign a different Fitness Instructor/Trainer to the member at any time without prior notice.
      13. Babel reserves the rights to sell personal training package at different rates and terms, without prior notice.
      14. Fitness Instructor/Trainer expressly notes that results will differ for each individual member based upon various factors including without limitation; body type, nutrition, etc. and no guarantees of results are possible.
      15. Proper nutrition and adequate rest are essential to this training program and the member must not be under the influence of drugs or alcohol at any time during the training session. 
      16. During each session the member is required to wear appropriate athletic footwear and loose, comfortable clothing to facilitate ease of movement. The member is not permitted to bring other individuals with him or her to the sessions unless the purchased session allows him or her to do so e.g. Buddy Personal Training.
      17. Fitness Instructor/Trainer is not responsible for the safety of facilities or equipment whether provided by member, Fitness Instructor/Trainer, or others.
      18. No implied warranties or representations are made other than those expressly contained herein and this document contains all of the terms of the Agreement between the parties. 

       

      DAY PASS | DANCE PASS

       

      DAY PASS

      1. The Day Pass holder is entitled to use the specified outlet's facilities for that day with unlimited access, which includes the gymnasium, the swimming pool if any, and attend classes and will expire by the end of the specified day, subject to Babel's opening hours.
      2. The Day Pass is only valid for one (1) individual and is non-assignable, non-refundable and non-transferable once it has been assigned to him or her.
      3. The Day Pass holder will be subjected to Babel's rules and the general terms and conditions below and the Management reserves the right to refuse entry and terminate the validity of the pass immediately if the holder was found not observing the said rules.
      4. The Day Pass holder can book classes either over-the-counter at specified outlet's reception or call the front desk in advance. Bookings for classes will be open three (3) days in advance and he or she can check the schedule at www.babel.fit/schedule. Spaces are not guaranteed and are subject to availability.
      5. In the event where there are changes to the class' time, venue, instructor or the type of workout due to unforeseen circumstances, Babel will try to inform in advance but it is highly advisable to check the schedule before coming over to the gym. Babel will try to manage this risk but will not be held responsible for the inconvenience it may caused arising from this change.
      6. The Day Pass holder is not entitled to membership perks e.g. Babel Perks with partnered brands and retail and food and beverages discounts and is not allowed to purchase personal training sessions.
      7. The Management reserves the right to refuse any sale of Day Pass for any reason whatsoever.                           
      8. Refunds - Day Pass sold is NOT refundable for any reason whatsoever and is not available for resale.
      DANCE PASS
      1. The Dance Pass holder is only entitled to book for one (1) dance class, either Choreography by Mayhem, GRIIND, Groove Thang or Stop:Motion at the specified outlet and will expire by the end of the specified day, subject to Babel's opening hours.
      2. The Dance Pass holder can book the class either over-the-counter at specified outlet's reception or call the front desk in advance. Bookings for classes will be open three (3) days in advance and he or she can check the schedule at www.babel.fit/schedule. Spaces are not guaranteed and are subject to availability.
      3. The Dance Pass is only valid for one (1) individual and is non-assignable, non-refundable and non-transferable once it has been assigned to him or her.
      4. The Dance Pass holder will be subjected to Babel's rules and the general terms and conditions below and the Management reserves the right to refuse entry and terminate the validity of the pass immediately if the holder was found not observing the said rules.
      5. In an uncommon event of over-booking where a spot has been reserved for the holder by Babel but is unable to attend the class because it is full, the holder will be entitled to select a different day of the dance classes above by the same dance instructor.
      6. In an uncommon event where there is any changes to the timing, venue, instructor or the type of workout that occurred due to unforeseen circumstances, Babel will try to inform the participants in advance but it is highly advisable to check the schedule before coming over to the gym. Babel will try to manage this risk but will not be held responsible for the inconvenience it may caused arising from this change.
      7. The Dance Pass holder is not entitled to membership perks e.g. Babel Perks with partnered brands and retail and food and beverages discounts and is not allowed to purchase personal training sessions.
      8. The Management also reserves the right to refuse any sale of Dance Pass for any reason whatsoever.
      9. Refunds - Dance Pass sold is NOT refundable for any reason whatsoever and is not available for resale.

       

      BABEL ACADEMY

      1. Any individual or body (collectively known as “Client”) who is interested in registering for the programmes, training, courses, workshops, events or other activities organised under the brand Babel Academy (collectively known as "workshops") will be subjected to the following terms and conditions.
      2. Registration constitutes a request by the Client to apply for and attend a specific workshop, however, such request shall not result in a workshop booking/reservation unless and until full payment has been received and successfully processed and verified.
      3. The Management reserves the right to reject any application for the workshops for any reason whatsoever.
      4. The workshop fee, unless stated, covers the provision of workshop material and documentation, if any.
      5. In the event that the workshop is completed within the allocated time period thereby resulting in an early finish, no adjustment to the fee may be requested and in no such case will Babel grant a refund.
      6. By registering and paying for workshops where Babel is a distributor, administrator, agent, partner or the equivalents for a third party, the Client hereby agrees to the terms and conditions set forth by the said third party.
      7. For workshops that provide certification by a third party, Babel will not be responsible and liable for the said certification. Any disputes or requests regarding the certification shall be directed to the third party by the Client.
      8. Refunds and Cancellation - The Client may cancel his or her registration for any workshop with a minimum of fifteen (15) business days’ written notice. No refunds of payments effected shall be given. In the event that the Client’s notice for cancellation is less than the minimum requirement above, the full fee shall remain chargeable and no refund will be granted to the Client.
      9. Babel reserves the right, at any time and for any reason, to cancel, reschedule or re-arrange the date allocated for any workshop. In the event that a workshop is cancelled or a Client will not be able to attend the said workshop on the rescheduled date, Babel shall provide the Client with a full refund of the fee paid for the cancelled or rescheduled Course and there will be no further liability upon Babel.
      10. Client is responsible for advance notification to Babel of any special requirements or physical issues he or she may face. Babel will endeavour to accommodate such notified needs if it is considered both reasonable and practical to do so.
      11. In very rare circumstances the stated maximum class size might be exceeded where a spot has been reserved for the Client by Babel but is unable to attend the class because it is full, the Client will be entitled for a refund or convert the amount into credits which can be used for any other Babel products and services.
      12. Babel reserves the right to exclude any Client from any workshop due to disorderly conduct or failure to adhere to Babel’s rules. The relevant fee shall remain chargeable to Client in such circumstances and not refundable, if paid.
      13. Babel may photograph or film the workshops of which the Client may be in it for marketing purposes. These images may be used on Babel’s website, Babel App, social media or any other marketing materials.
      14. The copyright in and all other intellectual property (IP) rights relating to the workshop, data and documentation employed by Babel and any related materials provided to are owned exclusively by and hereby reserved to Babel and/or its party licensors. Babel hereby grants to the Client a non-exclusive, non-transferable, non-sub-licensable licence to use such materials solely for the purpose of receiving the workshop. Under no circumstances may any part of the materials be produced or copied in any form or by any means or translated into another language by the Client.
      15. The workshop and any materials provided are not intended to be a definitive or comprehensive analysis of the subject and should not be deemed to constitute a substitute for professional advice.
      16. Babel reserves the right to amend the content of any workshop without prior notice when, in the opinion of Babel, such amendment does not fundamentally change the content of such workshop.
       

      CORPORATE PARTNERSHIPS

      1. In addition to the terms and conditions stated in this document, the packages provided will be subjected to terms agreed between both Babel and the corporate over a period of time.
      2. For the 6 Months and 12 Months Pay Monthly membership contracts, the membership will be automatically converted to the Pay Monthly (no lock-in period) contract at the end of the billing cycle. The availability of the new corporate package will be depending on the new commercial terms agreed between Babel and the corporate for the coming year. These contracts are also subjected to the terms in "GENERAL > MEMBERSHIP BILLING", specifically Clause 3,4 and 5.
      3. If a corporate member wishes to switch the package at the end of the billing cycle, please inform us at [email protected] 7 days before the final billing date.

      PROMOTION: JANUARY 2020

      1. Members must select between membership types upon registration, i.e. Single Club or All Clubs.
      2. Members cannot switch membership type after selection during the 3-month period.
      3. Normal membership Terms & Conditions as per the above applies.
      4. Eligible for new-to-club clients only.
      5. Membership auto renews to "Pay Monthly" membership of the selected club unless cancellation requested 7 days before billing date.
      6. Only valid till 31 January 2020.

      GENERAL


      PERSONAL FITNESS DECLARATION

      1. Before engaging into any of our fitness activities, we strongly advise that you obtain a medical clearance from a Doctor if you have any doubts about your physical capability to engage in any exercise.
      2. You are to abide with Babel's rules and instructions including warning notices when using our equipment and facilities. If you experience any illness or discomfort physically, please notify us immediately. We are not responsible in terms of medical requirements of our members.

      LIMITATION OF LIABILITY

      1. By attending classes, events, activities, using training facilities and equipment, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers whilst exercising in Babel. You acknowledge that you have voluntarily chosen to participate in intense physical activity. You hereby agree to assume full responsibility for yourself and all injuries or damage, which are sustained or aggravated by you in relation to the use of equipment and/or our training facilities, and release, indemnify, and hold harmless of Babel.
      2. Babel accepts no responsibility for loss or damage on members' or their guests' properties or for death or injuries sustained while on the premises. Members and their guests agree that no claims will be made against Babel, the Management or staff for any reason whatsoever.
      3. Babel, its associated companies, employees or agents shall not be responsible for any claims, demands, injuries, damages or actions for negligence arising on account of death or due to injury, loss, damage or theft to a member's person or property arising out of or in connection with the use by a member of any of the services, facilities on the premises of Babel. The member hereby holds Babel, its associated companies, employees and agents harmless from all claims which may be brought against them by or on a member's behalf for any such injuries or claims aforesaid. Any guest of a member or a temporary visitor to Babel shall agree to abide by Babel's rules and the same limitation of liabilities for a member shall apply. All prices and amount quoted here are subject to taxes where applicable.

      MEMBERSHIP BILLING

      1. For the Pay Monthly contract, the membership fee for the service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your Payment Method on the calendar day corresponding to the commencement of the paying portion of your membership, also known as the “Billing Date”. In some cases your payment date may change, for example if it corresponds to your first visit.
      2. For the Prepaid 6 Months and 12 Months membership contract, your membership will be automatically converted to the Pay Monthly contract at the end of the billing cycle. If you wish to maintain your 6 Months or 12 Months membership contract, please inform us at [email protected] 7 days before your billing date.
      3. Corporate Packages’ validity is subjected to the requirements set forth by Babel and agreed by the corporate client. Babel reserves the right to revise the membership plan back to the original shelf prices if those requirements are not met. e.g. no longer a staff of the company or fail to meet the minimum required accounts from the company.
      4. For Pay Monthly Corporate Packages with 6 Months or 12 Months contract, the membership fee for the service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your Payment Method on the calendar day corresponding to the commencement of the paying portion of your membership, also known as the “Billing Date”. In some cases your payment date may change, for example if it corresponds to your first visit. If you wish to terminate your membership before the end of the contract, you are required to settle all outstanding payments and remaining months’ membership fees for the tenure before cancellation can occur. The membership is also subjected to Membership Billing Clause 3.
      5. To use the service you must provide one or more Payment Methods e.g. debit card or credit card. By adding your card, you authorise us to continue to charge the applicable Payment Method(s). You authorise us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts.
      6. We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to our subscription plans, if applicable, will apply to you no earlier than 30 days following notice to you.

      MISCELLANEOUS

      1. Soliciting and selling memberships, private personal training sessions, merchandises or retail products to any member are prohibited and shall result in immediate termination of a member concerned without refund.
      2. Failure by the Management to enforce any of the their respective rights at any time for any period shall not be construed as a waiver of such rights
      3. The Management reserves the right to use any individual or group photographs of members and/or guests for press or promotional purpose.
      4. Any guests or members are not allowed to photograph or copy any club interior designs, promotional materials, tag lines or theme.
      5. All members must abide by the rules of Babel which may be amended, varied, deleted and added from time to time at the Management's discretion.
      6. Babel reserves the right to proceed with legal action to any member caught distributing, sharing or supplying such contents to any third party vendor or competitor.
      7. These Rules shall be governed and construed in accordance with the laws of Malaysia and subject to the jurisdiction of Malaysia.

      PRIVACY POLICY

      1. Babel respects your privacy and use your personal information in an effort to offer our members the perfect wellness experience. The Privacy Policy describes the privacy practices of Babel, including the types of personal information we collect from our members and guests and from other users of our website, official social media platforms and the downloadable Babel-branded mobile application (collectively known as “Babel App”), how we use this personal information and with whom we share it, in accordance with the Personal Data Protection Act 2010. By using or interacting with the Babel App, you are acknowledging that you have read, understand and agreed to and expressly consent to our collection, use and disclosure of your personal information, as described in the Privacy Policy.

This Privacy Policy (the “Policy”) describes the privacy practices of Babel, including the types of personal information we collect from our members and guests and from other users of our website https://www.babel.fit and https://www.babel.education, official social media platforms and the downloadable Babel-branded mobile application (collectively known as “Babel App”), how we use this personal information and with whom we share it, in accordance with the Personal Data Protection Act 2010 (the “Act”). When we refer to personal information in this Privacy Policy, we mean any information relating to an identified or identifiable natural person.

       

      By using or interacting with the Babel App, you are acknowledging that you have read, understand and agreed to the Privacy Policy and expressly consent to our collection, use and disclosure of your personal information, as described in this Privacy Policy.

       

      About this Policy

       

      This Policy sets out the essential details relating to your personal information relationship with Babel. This Policy applies to all Babel’s products and services, including all retail and food and beverages sold under the trade name Babel (collectively known as “Babel’s products and services”). The terms governing your use of the Babel’s products and services are defined in our Terms and Conditions.

       

      From time to time, we may develop new or offer additional products and services. If the introduction of these new or additional products and services result in any change to the way we collect or process your personal information we will provide you with more information and additional terms or policies. Unless stated otherwise when we introduce these new or additional services, they will be subject to this Policy.

       

      The aim of this Policy is to:

      • Ensure that you understand what personal information we collect about you, the reasons why we collect and use it, and who we share it with;

      • Explain the way we use the personal information that you share with us in order to provide you the best wellness journey when you are using the Babel’s products and services; and

      • Explain your rights and choices in relation to the personal information we collect and process about you and how we will protect your privacy.

      Collection of Personal Information


      We receive and store information about you, from which you are identifiable, including but not limited to your name, nationality, personal identity document number, address, telephone number, email address, credit card details, payment method and history, gender, date of birth, financial background, your occupation, your photo, data relating to your health and workout, and any information about you which you have provided to Babel in using our products and services, interact with our Customer Service or official social media platforms, registration forms, application forms or any other similar forms that has been or may be collected, stored, used and/or processed by Babel from time to time.

       

      We also collect information about you and your use of our service, your interactions with us and our advertising, as well as information regarding your computer or other device used to access our service. This information includes:

      • Your activity on the Babel and the Babel App services, such as, but not limited to, application usage, club check-ins, hours of usage, payment record, training progress, personal training and class bookings and attendance, body composition, calories burned, distance traveled, search queries and retail and food and beverage purchases;

      • Your interactions with our email, push and text messaging;

      • Details of your interactions with Customer Service, such as the date, time and reason for contacting us, transcripts of any chat conversations, and if you call us, your phone number and call recordings;

      • Device IDs or other unique identifiers;

      • Advertising identifiers, such as those on mobile devices, tablets, and streaming media devices that include such identifiers;

      • Device and software characteristics (such as type and configuration), connection information, statistics on page views, referring source (for example, referral URLs), IP address (which may tell us your general location), browser and standard web server log information; and

      • Information collected via the use of cookies, web beacons and other technologies, including ad data (such as information on the availability and delivery of ads, the site URL, as well as the date and time).

      In addition to the personal information you provide to Babel directly, Babel may collect your personal information from publicly available sources or from third parties, for example, from:

      • Filled up application or registration forms, surveys or training tools or other similar forms;

      • Publicly available sources such as directories and online materials such as articles and social media (privacy setting set at public);

      • Babel’s official social media pages or accounts, if you follow, like or are a fan of such pages or accounts;

      • When you interact and communicate with Babel at any events or activities or contests;

      • Other entities who provide you with services or with whom you have a contractual relationship and has the right to share the information with Babel; or

      • Marketing service providers or partners.

      All members are required to input their personal information into our database via the Babel App. However, if you do not provide Babel your personal information, Babel will not be able to process your personal information and may cause Babel to be unable to provide services or products to or accept payments from you.

       

      Use of Information

       

      We use information to provide, analyse, administer your account, enhance and personalise our products and services and marketing efforts, to process your registration, your purchases and your payments, and to communicate with you on these and other topics. For example, we use information to:

      • Carry out research, analyse and understand our members’ demographics and behavior to develop, enhance and personalise products and services towards improving your experience with us;

      • Assist us in responding to your queries and requests efficiently;

      • Process payments and to prevent or detect fraud when you are purchasing from us. For example, payments that you make will be processed by our appointed service provider. Disclosure to these payment processing service provider is necessary for the purpose of conducting the sale transaction that you have opted for; and

      • Process your personal information for more general use such as internal membership administrative purposes, maintain the safety and security of our products and services, and to comply with its obligations under the law.

      In addition to the use of personal information outlined above, you may be subscribed to our newsletters, announcements, surveys, marketing and or promotional materials from time to time. These marketing and or promotional materials may come from Babel or through affiliation with third parties, you can choose to unsubscribe by selecting the unsubscribe function within the electronic marketing material or let us know at [email protected]. Please note that if you unsubscribe, we may still send you service-related messages, such as important announcements, account administration such as password resets, payment receipts and reminder for outstanding dues. You can always opt back in by contacting us at [email protected] at any point in time.

       

      Disclosure of Information

       

      We are committed to remain your information confidential and not share it with any other parties other than the parties you have authorised as described below:

       

      The Babel Family
      We share your information among the Babel family of companies, subsidiaries, holding companies, associated companies, or affiliates of, or companies controlled by, or under common control with Babel as needed for: data processing and storage; providing you with access to our services; providing customer support; making decisions about service improvements; product development; and for other purposes described in the “Use of Information” section of this Privacy Policy.

       

      Service Providers
      We use other companies, agents or contractors ("Service Providers") to perform services on our behalf or to assist us with the provision of services to you and has undertaken to keep such information confidential, provided such person or company has a legitimate right to such information. For example, we may engage Service Providers to provide marketing, advertising, communications, infrastructure and IT services, to personalise and optimise our service, to process credit card transactions or other payment methods, to provide customer service, to collect debts, to analyse and enhance data (including data about users' interactions with our service), and to process and administer consumer surveys. In the course of providing such services, these Service Providers may have access to your personal or other information. We do not authorise them to use or disclose your personal information except in connection with providing their services and will require them to delete or destroy the information.

       

      Promotional Offers
      We may offer joint promotions or programmes that, in order for your participation, will require us to share your information with third parties. In fulfilling these types of promotions, we may share your name and other information in connection with fulfilling the incentive. Please note that these third parties are responsible for their own privacy practices.

       

      Business Transfers
      In connection with any reorganisation, restructuring, merger or sale, or other transfer of assets, we will transfer information, including personal information, provided that the receiving party agrees to respect your personal information in a manner that is consistent with our Privacy Policy.

       

      Notwithstanding, personal information may be disclosed for any purpose other than the above if:

      • The disclosure is necessary for the purpose of preventing or detecting a crime, or for the purpose of investigations or was required or authorised by or under any law or by the order of a court;

      • Babel acted in the reasonable belief that we had in law the right to disclose the personal information to the other person;

      • Babel acted in the reasonable belief that we would have had your consent if you had known of the disclosing of the personal information and the circumstances of such disclosure; or

      • The disclosure was justified as being in the public interest in circumstances as determined by the minister charged with the responsibility for the protection of personal information.

      You may also choose to disclose your information in the following ways, but not limited to:

      • While using the Babel App, you may have opportunities to post reviews, feedback or other information publicly, and third parties could use the information you disclose;

      • Certain portions of our service may contain a tool which gives you the option to share information by email, text message and social, within the Babel App, or other sharing applications, using the clients and applications on your smart device; and

      • Social plugins and similar technologies allow you to share information. Social plugins and social applications are operated by the social networks themselves, and are subject to their terms of use and privacy policies.

      Accuracy of Your Information and Your Rights to Access Your Information

       

      All members are required to input their personal information into our database via the Babel App. To ensure that the personal information collected is accurate, complete, not misleading and kept up-to-date, we have designed specific fields with rules, if applicable, to reduce errors, wrong information and incomplete forms. We will also be sending push notifications on a periodic basis to remind you to review the validity of your information. In situations where we deem information that was inputted is insufficient or inaccurate, we will reach out to you in writing to provide further information or revise the current one if necessary.

       

      On the other hand, you have your rights over your information. You can request access to your personal information and to correct or update out-of-date or inaccurate personal information we hold about you, except where compliance with a request to such access or correction is refused under the Act. You can most easily do this by visiting the "Account" portion of the Babel App, where you have the ability to access and update information about your account.

       

      We may reject requests that are unreasonable or not required by law, including those that would be extremely impractical, could require disproportionate technical effort, or could expose us to operational risks such as free trial fraud.

       

      Security of Your Personal Information

       

      Babel ensures that all information collected will be safely and securely stored. We protect your personal information by implementing technical and organisational measures that are designed to provide a level of security appropriate to the risks of processing your personal information. Those measures are, but not limited to, the following :

      • Allowing access to personal information only via passwords;

      • Maintaining technology products to prevent unauthorised computer access;

      • Securely destroying your personal information when it is no longer needed for our record retention purposes;

      • All data is transported securely with end-to-end SSL encryption and stored using 256 bit Advanced Encryption Standard. For hard copy formats, these documents will be filed and locked in dedicated cabinets; and

      • From a user’s perspective, your password protects your user account, so we encourage you to use a unique and strong password and limit access to your mobile device or computer.

      These measures are designed to provide a level of security appropriate to the risks of processing your personal information, however, please note that no system is ever completely secure.

       

      Retention of Personal Information

       

      We keep your personal information only as long as necessary to provide you our products and services and for legitimate and essential business purposes, such as maintaining the quality and performance of our products and services, making data-driven business decisions, complying with our legal obligations, and resolving disputes.

       

      Upon your request, we will delete or anonymise your personal information so that it no longer identifies you, unless, we are legally allowed or required to maintain certain personal information, including situations such as the following:

      • If there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute we will retain the necessary personal information until the issue is resolved;

      • Where we are required to retain the personal information for our legal, tax, audit, and accounting obligations, we will retain the necessary personal information for the period required by applicable law; and/or

      • Where necessary for our legitimate business interests such as fraud prevention or to maintain the security of our users.

      Dari masa ke semasa, kami mungkin akan menghasilkan atau menawarkan produk dan perkhidmatan tambahan. Sekiranya pengenalan produk dan perkhidmatan baru ini menyebabkan kelainan dalam cara kami mendapatkan atau memproses maklumat peribadi anda kami akan memberikan lebih maklumat serta terma atau polisi tambahan mengenainya. Melainkan tidak dinyatakan sewaktu pengenalan perkhidmatan baru atau tambahan ini, ianya adalah tertakluk kepada Polisi ini.

      • Memastikan anda memahami apakah maklumat peribadi anda yang digunakan, tujuan kami mengumpul dan menggunakannya serta dengan pihak yang kami kongsikan;
      • Menerangkan cara kami menggunakan maklumat peribadi yang anda kongsikan kepada kami untuk memastikan anda memperolehi pengembaraan kesihatan yang terbaik ketika anda menggunakan produk dan perkhidmatan Babel; dan
      • Menerangkan hak dan pilihan anda berkenaan dengan maklumat peribadi yang kami peroleh dan proses mengenai anda serta bagaimana kami akan melindungi privasi anda.

      Pengumpulan Maklumat Peribadi

       

      Kami menerima dan menyimpan maklumat mengenai anda, dari ketika anda dikenalpasti, termasuk namun tidak terhad kepada nama, kewarganegaraan, nombor dokumen pengenalan diri, alamat, nombor telefon, alamat emel, butir-butir kad kredit, sejarah dan cara pembayaran, jantina, tarikh lahir, latar belakang kewangan, pekerjaan anda, gambar anda, data berkaitan kesihatan serta senaman anda, dan mana-mana maklumat mengenai anda yang telah diberikan kepada Babel dalam penggunaan produk dan perkhidmatan kami, interaksi anda dengan Pusat Khidmat Pelanggan kami atau platform-platform media semasa rasmi, borang pendaftaran, borang permohonan atau mana-mana borang seumpamanya yang telah atau akan dikumpul, disimpan, digunakan serta/atau diproses oleh Babel dari masa ke semasa.

       

      Kami juga mengumpul maklumat mengenai anda dan penggunaan anda ke atas perkhidmatan kami, interaksi anda dengan kami dan juga pengiklanan kami, serta maklumat berkaitan komputer atau alat elektronik anda yang lain yang digunakan untuk mengakses perkhidmatan kami. Maklumat ini merangkumi:

      • Aktiviti anda di perkhidmatan Babel dan Babel App, seperti, tetapi tidak terhad kepada, penggunaan aplikasi, daftar masuk kelab, tempoh penggunaan, rekod pembayaran, perkembangan latihan, latihan peribadi serta penempahan kelas dan kehadiran, komposisi badan, kalori yang telah dibakar, jarak perjalanan, carian pertanyaan dan barangan runcit serta pembelian makanan dan minuman;
      • Interaksi anda dengan emel kami, pemberitahuan segera dan teks;
      • Butir-butir interaksi anda dengan Pusat Khidmat Pelanggan, seperti tarikh, masa dan tujuan menghubungi kami, mana-mana transkrip perbualan, dan sekiranya anda menghubungi kami, nombor telefon anda dan rakaman perbualan telefon;
      • ID alat elektronik atau pengenalpastian unik lain;
      • Pengenalpastian pengiklanan, seperti yang terdapat di dalam alat mudah alih, tablet, peralatan penyiaran media yang disertakan dengan pengenalpastian seumpamanya;
      • Ciri-ciri peralatan dan perisian (seperti jenis dan konfigurasi), maklumat hubungan, statistik paparan halaman, punca rujukan (sebagai contoh, rujukan URL), alamat IP (yang mungkin akan mengenalpasti lokasi umum anda), pelayar dan maklumat log server sesawang piawaian; dan
      • Maklumat yang dikumpul melalui cookies, penghantar isyarat laman sesawang dan teknologi lain, termasuklah data iklan (seperti maklumat mengenai ketersediaan dan penghantaran iklan, laman URL, serta tarikh dan masa).

      Selain daripada maklumat peribadi yang anda berikan kepada Babel secara langsung, Babel mungkin akan mendapatkan maklumat peribadi anda daripada sumber-sumber umum atau pihak ketiga, contohnya, dari:

      • Borang-borang permohonan atau pendaftaran, kaji selidik atau latihan yang diisi atau mana-mana borang lain yang seumpamanya;
      • Laman rasmi media sosial atau akaun Babel, sekiranya anda mengikuti, menyukai atau peminat laman-laman atau akaun seumpamanya;
      • Ketika anda berinteraksi dan berkomunikasi dengan Babel di mana-mana acara atau aktiviti atau pertandingan;
      • Mana-mana entiti lain yang memberikan anda perkhidmatan atau dengan sesiapa yang anda ada hubungan persetujuan dan mempunyai hak untuk berkongsi maklumat dengan Babel; atau
      • Pembekal perkhidmatan pengiklanan atau rakan-rakan kongsi.

      Semua ahli adalah diminta untuk memberikan maklumat peribadi mereka ke dalam pangkalan data kami melalui Babel App. Bagaimanapun, sekiranya anda tidak memberikan maklumat peribadi anda kepada Babel, Babel tidak berupaya memproses maklumat peribadi anda dan mungkin akan menyebabkan Babel tidak dapat memberikan perkhidmatan atau produk atau menerima bayaran daripada anda.

       

      Penggunaan Maklumat

       

      Kami menggunakan maklumat untuk memberi, menganalisa, mengendali akaun anda, menaiktarafkan dan mengkhususkan produk dan perkhidmatan kami serta usaha pengiklanan kami, untuk memproses pendaftaran anda, pembelian dan pembayaran anda, dan untuk menghubungi anda mengenainya dan topik lain. Sebagai contoh, kami menggunakan maklumat bagi tujuan:

      • Menjalankan kajian, menganalisa dan memahami demografik dan tingkahlaku ahli-ahli kami untuk membangunkan, menaiktaraf dan mengkhususkan produk dan perkhidmatan ke arah memperbaiki pengalaman anda bersama kami;
      • Membantu kami dalam memberi maklum balas pertanyaan dan permintaan anda dengan lebih berkesan;
      • Memproses pembayaran dan mencegah atau mengesan pemalsuan apabila anda membuat pembelian dengan kami. Sebagai contoh, pembayaran yang anda buat akan diproses oleh pembekal perkhidmatan yang telah dilantik oleh kami. Pendedahan kepada pembekal perkhidmatan berkaitan proses pembayaran ini diperlukan bertujuan untuk menjalankan transaksi pembelian yang telah dipilih oleh anda; dan
      • Memproses maklumat peribadi anda bagi tujuan yang lebih umum seperti bagi tujuan pengendalian keahlian dalaman, mengekalkan ciri-ciri keselamatan dan perlindungan produk serta perkhidmatan kami, dan demi mematuhi semua tanggungjawabnya di sisi undang-undang.

      Selain daripada penggunaan maklumat peribadi yang digaris di atas, anda mungkin akan menerima langganan risalah berita, pengumuman, kaji-selidik, bahan-bahan pemasaran dan atau promosi dari masa ke semasa. Bahan-bahan pemasaran dan promosi ini mungkin datangnya dari Babel atau melalui persetujuan dengan pihak ketiga, anda boleh memilih untuk tidak melanggan dengan memilih fungsi pembatalan langganan di bahan pemasaran elektronik atau dengan memberitahu kami di [email protected]. Sebagai peringatan sekiranya anda membatalkan langganan, kami mungkin akan masih menghantar pesanan-pesanan yang berkaitan dengan perkhidmatan kami, seperti pengumuman penting, pengendalian akaun seperti menetapkan semula kata laluan, resit pembayaran dan peringatan baki tertunggak.       Pendedahan Maklumat

      Kami berkongsi maklumat sesama keluarga syarikat Babel, anak-anak syarikat, syarikat-syarikat induk, syarikat-syarikat sekutu, atau yang berhubungkait dengan, atau syarikat-syarikat yang dikendalikan, atau dibawah kendalian bersama dengan Babel bagi tujuan; memproses dan menyimpan data; memberikan anda akses kepada perkhidmatan kami; memberikan sokongan pelanggan; membuat keputusan mengenai peningkatan perkhidmatan; pembangunan produk; dan juga untuk tujuan lain seperti yang dinyatakan di dalam bahagian “Penggunaan Maklumat” Polisi Privasi ini.

       

      Pembekal Perkhidmatan
      Kami menggunakan syarikat, ejen atau kontraktor lain (Pembekal Perkhidmatan) untuk melaksanakan perkhidmatan bagi pihak kami atau membantu kami dalam membekalkan perkhidmatan kami kepada anda dan mereka telah diamanahkan untuk memastikan maklumat anda adalah sulit, melainkan dia atau syarikat itu mempunyai hak yang sah ke atas maklumat tersebut. Sebagai contoh, kami mungkin akan melibatkan Pembekal Perkhidmatan untuk membuat pemasaran, pengiklanan, pemberitahuan, infrastruktur dan perkhidmatan IT, untuk mengkhususkan dan mengoptimumkan perkhidmatan kami, untuk memproses urus niaga kad kredit atau lain-lain cara pembayaran, untuk memberikan khidmat pelanggan, untuk memungut hutang, untuk menganalisa dan meningkatkan maklumat (termasuklah maklumat berkaitan dengan interaksi pengguna dengan perkhidmatan kami), dan untuk memproses dan mengendalikan tinjauan pengguna. Dalam urusan memberikan perkhidmatan seperti ini, Pembekal Perkhidmatan ini mungkin akan mengakses maklumat peribadi dan maklumat lain anda. Kami tidak membenarkan mereka untuk mengguna atau mendedahkan maklumat peribadi anda kecuali dalam urusan berkaitan dengan memberikan perkhidmatan mereka dan memerlukan mereka untuk memadamkan dan menghapuskan maklumat tersebut.

       

      Tawaran Promosi
      Kami juga mungkin akan menawarkan gabungan promosi atau program yang, demi penglibatan anda, memerlukan kami untuk berkongsi maklumat anda dengan pihak ketiga. Dalam menjalankan promosi jenis ini, kami mungkin akan mendedahkan nama anda dan berkongsi maklumat lain dalam melaksanakan saranan tersebut. Untuk pengetahuan anda pihak ketiga ini bertanggungjawab ke atas amalan privasi mereka sendiri.

       

      Pemindahan Perniagaan
      Dalam sebarang penyusunan semula, penstrukturan semula, penggabungan atau penjualan, atau mana-mana pemindahan aset, kami akan memindahkan maklumat, termasuklah maklumat peribadi, dengan syarat pihak penerima bersetuju untuk menghormati maklumat peribadi anda selaras dengan Polisi Privasi kami.

       

      Walau bagaimanapun, maklumat peribadi mungkin didedahkan untuk apa-apa tujuan melainkan seperti di atas sekiranya:

      • Pendedahkan adalah diperlukan bagi tujuan pencegahan atau mengesan jenayah, atau bagi tujuan penyiasatan atau telah diminta atau diarahkan oleh atau dibawah mana-mana undang-undang atau atas arahan mahkamah;
      • Babel bertindak dengan munasabah bahawasanya di dalam undang-undang kami mempunyai hak untuk mendedahkan maklumat peribadi kepada pihak lain;
      • Babel bertindak dengan munasabah bahawasanya kami mendapat persetujuan anda sekiranya anda tahu mengenai pendedahan maklumat peribadi dan keadaan bagaimana ia didedahkan; atau
      • Pendedahan itu adalah wajar untuk kebajikan umum dalam keadaan itu seperti yang telah ditentukan oleh pihak berkuasa yang bertanggungjawab dalam melindungi maklumat peribadi tersebut.

      Anda juga boleh memilih untuk mendedahkan maklumat anda dengan cara dibawah, namun tidak terhad kepada:

      • Semasa menggunakan Babel App, anda mungkin berpeluang untuk memberikan pandangan, maklum balas atau maklumat-maklumat lain secara terbuka, dan pihak ketiga boleh menggunakan maklumat yang anda telah dedahkan;
      • Sesetengah bahagian perkhidmatan kami mungkin mempunyai alat yang akan memberikan anda pilihan untuk berkongsi maklumat melalui emel, pesanan teks dan media semasa, di dalam Babel App atau mana-mana aplikasi kongsian lain, menggunakan pelanggan dan aplikasi pada peralatan pintar anda; dan
      • Plugin media semasa dan teknologi seumpamanya membolehkan anda berkongsi maklumat. Plugin dan aplikasi media semasa adalah dioperasi oleh rangkaian media semasa itu sendiri, dan tertakluk kepada terma penggunaan dan polisi privasinya sendiri.

      Ketepatan Maklumat Dan Hak Anda Mengakses Maklumat

       

      Semua ahli adalah diminta untuk mengisi maklumat peribadi mereka ke dalam pangkalan data melalui Babel App. Demi memastikan ketepatan maklumat yang dikumpul adalah tepat, lengkap, tidak mengelirukan dan terkini, kami telah mereka ruang-ruang tertentu dengan tetapan, sekiranya berkaitan, untuk mengurangkan kesilapan, maklumat yang salah dan borang-borang yang tidak lengkap. Kami juga akan menghantar pemberitahuan segera secara berkala untuk mengingatkan anda untuk menyemak semula kesahihan maklumat anda. Dalam situasi di mana kami mendapati bahawa maklumat yang diberikan adalah tidak mencukupi atau tidak tepat, kami akan menghubungi anda secara bertulis untuk meminta anda memberikan maklumat lanjut atau menyemak semula maklumat yang terkini sekiranya perlu.

       

      Walau bagaimanapun, anda mempunyai hak ke atas maklumat anda. Anda boleh meminta untuk mengakses maklumat peribadi anda dan membetulkan atau mengemaskini maklumat yang lama atau maklumat yang tidak tepat yang kami ada mengenai anda, melainkan menuruti permintaan untuk mengakses atau pembetulan adalah tidak dibenarkan oleh mana-mana Akta. Anda boleh melakukannya dengan mengunjungi ruang “Akaun” di Babel App, di mana anda boleh mengakses dan mengemaskini maklumat mengenai akaun anda.

       

      Kami boleh menolak permintaan yang tidak munasabah atau tidak diperlukan oleh undang-undang, termasuklah yang terlampau tidak praktikal, memerlukan usaha teknikal yang tidak berbaloi, atau boleh mendedahkan kami kepada risiko pengoperasian seperti penipuan percubaan percuma.
       

      Perlindungan Maklumat Peribadi Anda

       

      Babel memastikan bahawa semua maklumat yang dikumpul adalah disimpan dengan selamat dan terjamin. Kami melindungi maklumat peribadi anda dengan melaksanakan langkah-langkah berjaga secara teknikal dan secara berorganisasi yang direka untuk memberikan tahap keselamatan yang setimpal dengan risiko dalam memproses maklumat peribadi anda. Langkah-langkah tersebut adalah, namun tidak terhad kepada, yang berikut:

      • Membenarkan akses kepada maklumat peribadi hanya dengan kata laluan
      • Mengekalkan produk teknologi bagi mencegah akses komputer tanpa kebenaran
      • Memusnahkan maklumat peribadi and dengan selamat apabila ia tidak lagi diperlukan bagi tujuan penyimpanan rekod kami
      • Semua data dipindahkan dari satu ke satu penerima penyulitan SSL dan disimpan dengan menggunakan 256 bit Piawaian Penyulitan Lanjutan. Bagi format bentuk bercetak, dokumen-dokumen ini akan difailkan dan dikunci di kabinet-kabinet khas; dan
      • Dari perspektif pengguna, kata laluan anda akan melindungi akaun anda, kami menggalakkan anda menggunakan kata laluan yang unik dan sukar dan menghadkan akses kepada peralatan mudah alih atau komputer anda.

      Langkah-langkah berjaga-jaga ini direka untuk memberikan tahap keselamatan yang setimpal dengan risiko dalam memproseskan maklumat peribadi anda, walau bagaimanapun, sebagai peringatan tiada sistem yang terlindung sepenuhnya.
       

      Pengekalan Maklumat Peribadi

       

      Kami menyimpan maklumat peribadi anda selama yang diperlukan bagi memberikan produk dan perkhidmatan kami kepada anda dan untuk tujuan perniagaan yang sah dan penting, seperti mengekalkan kualiti dan prestasi produk dan perkhidmatan kami, membuat keputusan permiagaan yang cenderung kepada data, mematuhi tanggungjawab perundangan kami, dan menyelesaikan pertikaian.

       

      Atas permintaan anda, kami akan memadamkan atau merahsiakan maklumat peribadi anda supaya ia tidak lagi mengenalpasti anda, melainkan, kami dibenarkan oleh undang-undang atau diminta untuk mengekalkan sebahagian maklumat peribadi, termasuklah dalam situasi berikut:

      • Sekiranya ada isu-isu yang tidak selesai berkaitan dengan akaun anda, seperti baki tertunggak pada akaun anda atau tuntutan atau pertikaian yang tidak selesai kami akan mengekalkan maklumat peribadi anda sehingga isu-isu ini selesai;
